End user license agreement
Effective 15 October 2026
This agreement is between you and Spring Digital Commerce LLC, Wilmington, Delaware, United States (the “Licensor”), for the MyAirport app (the “Licensed Application”). It sits alongside our terms of use and privacy policy. Where it is silent, Apple’s standard Licensed Application End User License Agreement applies.
1. Acknowledgement
You and the Licensor acknowledge that this agreement is concluded between you and the Licensor only, and not with Apple Inc. (“Apple”). The Licensor, not Apple, is solely responsible for the Licensed Application and its content. This agreement does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions in force on the date you accept it.
2. Scope of licence
The Licensor grants you a non-transferable licence to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may also be used by other accounts associated with you through Family Sharing or volume purchasing. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense it, and if you sell your Apple device to a third party you must remove the Licensed Application first. You may not copy, reverse engineer, disassemble, attempt to derive the source code of, modify or create derivative works of the Licensed Application, its updates or any part of it, except as permitted by applicable law.
3. Data
The Licensed Application does not collect personal data or send technical data about your device to the Licensor. Your game is saved on your device. See the privacy policy for details.
4. Maintenance and support
The Licensor is solely responsible for providing maintenance and support services for the Licensed Application, as described on myairport.app/support or as required under applicable law. You and the Licensor acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services for the Licensed Application.
5. Warranty
The Licensor is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty are the Licensor’s sole responsibility.
Subject to the above and to the extent permitted by law, the Licensed Application is provided “as is” and “as available”, with all faults and without warranty of any kind, and the Licensor disclaims all warranties and conditions, express, implied or statutory, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
6. Product claims
You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and use of it, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
7. Intellectual property rights
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, the Licensor, not Apple, is solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
8. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
9. Limitation of liability
To the extent not prohibited by law, in no event shall the Licensor be liable for personal injury or any incidental, special, indirect or consequential damages whatsoever, including damages for loss of profits, loss of data or game progress, business interruption or any other commercial damages or losses, arising out of or related to your use of or inability to use the Licensed Application, however caused. The Licensor’s total liability for all damages shall not exceed the greater of the amount you paid for the Licensed Application and in-app purchases in the twelve months before the claim, or fifty U.S. dollars (US$50.00). Nothing here limits liability that cannot be limited by law.
10. Termination
This licence is effective until terminated by you or the Licensor. Your rights under it end automatically if you fail to comply with any of its terms. On termination you must stop using the Licensed Application and delete all copies of it.
11. Third-party terms of agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application, such as your wireless data service agreement.
12. U.S. Government end users
The Licensed Application and related documentation are “Commercial Items”, as that term is defined at 48 C.F.R. §2.101, licensed to U.S. Government end users only as Commercial Items and with only those rights as are granted to all other end users under this agreement.
13. Governing law
This agreement is governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules. If you are a consumer in the European Union, the United Kingdom or another country with mandatory consumer protection law, you keep the protection of that law.
14. Developer name, address and contact
Spring Digital Commerce LLC, Wilmington, Delaware, United States. Questions, complaints or claims about the Licensed Application go to bas@springdigitalcommerce.com. Support: myairport.app/support.
15. Third-party beneficiary
You and the Licensor acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement, and that, upon your acceptance of its terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against you as a third-party beneficiary.
